The Ivy Institute LLC NOTICE OF SALE UNDER POWER 1161 Riverside Terrace, Gainesville, Georgia 30501 Under and by virtue of the power of sale granted by The Ivy Institute LLC ("Grantor") to and in favor of Frank Family Equities, LLC ("Grantee") in that certain Deed to Secure Debt, Assignment of Leases and Rents, Fixture Filing, and Security Agreement dated May 7, 2024, and recorded in Deed Book 9475, Page 65, Hall County, Georgia records (the "Security Deed"), securing repayment under: (a) that certain Secured Note from Grantor in favor of Grantee dated May 7, 2024, in the original principal amount of $136,500.00; and (b) that certain Loan and Security Agreement from Grantor in favor of Grantee dated May 7, 2024 (collectively, the "Secured Indebtedness"), there will be sold at public outcry by Grantee, as attorney-in-fact for Grantor, to the highest bidder for cash between the legal hours for sale before the Courthouse door in Hall County, Georgia on August 5, 2025, the following described property located in Hall County, Georgia, together with all improvements, personalty, fixtures, easements, hereditaments, rights, members, and appurtenances located thereon and described in the Security Deed (collectively, the "Property"): All that tract or parcel of land lying and being in Land Lot 146 of the 9th Land District, City of Gainesville, Hall County, GA and being Unit 1161 as shown on a plat of survey prepared by Patton-Boyer, Inc, Reg. Surveyor dated June 18, 2002, revised September 12, 2002 styled "Survey for Riverside Village Town Homes, a Condominium; and recorded in Hall County, GA Condominium Plat Book 900, Page 130 and 131. Said plat and the record thereof are herein incorporated for a full and complete legal description. Together with as an appurtenance to the above described property, its proportionate share of all common area, easements and other rights set forth for the benefit of the above described property in that certain Declaration of Condominium, recorded in Deed Book 4322, Page 429, Hall County, GA Deed Records. The above-described Property is commonly known as 1161 Riverside Terrace, Gainesville, Georgia 30501, according to the present system of property mapping in Hall County, Georgia. The Real Property tax identification number is 01-074-001-017C. The Secured Indebtedness has been accelerated and declared due because of, among other possible events of default, failure to pay the Secured Indebtedness as and when due and in the manner provided in the instruments evidencing the Secured Indebtedness and the Security Deed. The Security Deed therefore has become and is now foreclosable according to its terms. Accordingly, the Property will be sold at public outcry pursuant to the terms of the power of sale provided in the Security Deed. The Property will be sold on an "as is, where is" basis without recourse against Grantee and without representation or warranty of any kind or nature whatsoever by Grantee with respect thereto. The Property will be sold subject to any matters of record superior to the Security Deed, including without limitation, (a) outstanding ad valorem taxes with a senior lien priority to the Security Deed (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the Property, and (c) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, or other matters of record superior to the Security Deed. To the best of the undersigned's knowledge and belief, the owner of the Property is the Grantor and the party or parties in possession of the Property is the Grantor or tenants of the Grantor.
